Terms of Service
The agreement between your business and Leadco-Insureco Marketing LLC for using a LeadCo.Cloud platform.
1. Agreement
These Terms of Service are an agreement between Leadco-Insureco Marketing LLC ("LeadCo," "we") and the business that creates an account ("you"). By creating an account or using a LeadCo.Cloud platform you accept these terms.
2. The service
LeadCo.Cloud provides complete hosted business platforms: a public website, an AI assistant, industry software tools, hosting, TLS, and backups, at the pricing presented at signup. We operate, secure, and maintain the platform; you operate your business on it.
3. Your account
You agree to provide accurate information, keep your credentials confidential, and remain responsible for activity under your account. You must be authorized to act for the business you register.
4. Subscriptions and billing
Subscription fees are presented at signup and billed in advance on a recurring basis. Applicable taxes are your responsibility. We may suspend service for non-payment after reasonable notice. You may cancel at any time; cancellation stops future billing.
5. Your content and data
You own your business data. You grant us the limited rights needed to host, process, back up, and display it — solely to provide the service. You are responsible for the lawfulness of the content you publish and for how you use the data of your own customers.
6. Acceptable use
You agree not to use the service to: violate law; infringe intellectual property; send spam or deceptive communications; distribute malware; attempt to access other customers' data; interfere with the platform; or resell the service without our written consent. We may suspend accounts that put the platform or other customers at risk.
7. AI features
Platform AI assistants generate responses automatically. They are provided to help your business, but outputs may contain errors — review anything important before relying on or publishing it. You are responsible for how AI output is used in your business.
8. Professional responsibility
Some platforms support licensed professions (for example, real-estate appraisal). The software assists your workflow; professional judgment, compliance, and the content of professional deliverables remain your responsibility as the licensed professional.
9. Payments processing
Payments to you from your customers are processed by third-party PCI-DSS compliant processors (Square, Stripe, CSG Forte) under your agreements with them; their terms apply to those services.
10. Intellectual property
The platform, its software, and its designs are the property of Leadco-Insureco Marketing LLC. Suggestions you send us may be used to improve the service without obligation.
11. Termination
Either party may terminate at any time. On termination you may request an export of your business data; after a reasonable period we delete active copies, and residual copies age out of encrypted backups.
12. Disclaimers
The service is provided "as is" and "as available." To the fullest extent permitted by law we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of the service is limited to the subscription fees you paid in the twelve (12) months preceding the claim, and neither party is liable for indirect, incidental, or consequential damages.
14. Indemnification
You will defend and hold us harmless from claims arising out of your content, your business operations, or your violation of these terms.
15. Governing law
These terms are governed by the laws of the State of Alabama, USA, without regard to conflict-of-law rules.
16. Changes
We may update these terms; material changes will be posted here with a new effective date. Continued use after a change is acceptance.
